CBSA is reminding highway and rail carriers that the period of soft enforcement for ACI eManifest ends on January 10, 2016.

Starting January 11, 2016 ACI eManifests  carriers who do not comply with ACI eManifest requirements may be issued monetary penalties.

When applicable, the CBSA may issue penalties for:

  • failing to provide advance information;
  • failing to provide advance information in the prescribed time or in the prescribed manner;
  • failing to correct advance information;
  • failing to provide true/accurate/complete information; and/or
  • failing to comply with an electronic customs Risk Assessment notice.

According to the CBSA highway carriers that fail to comply with ACI eManifest requirements will experience delays in processing and maybe faced with monetary penalties, even if they voluntarily return to the United States.  Carriers are also reminded that they can not arrive at the border less then hour after CBSA acceptance of an ACI eManifest.   Carriers who are empty going into Canada are not required to file an ACI eManifest but they are highly encouraged to do so.  We are finding many of our drivers have been delayed or hassled at border points for not filing an empty ACI eManifest.

eManifest was introduced by the Government of Canada to enhance the safety, security and prosperity of Canadian international trade.  It will also streamline commercial cross-border processes while enhancing safety by applying rigorous risk assessments on the advanced data being transmitted.
