Canadian ELD mandate moved back until beginning of 2023
Once again, the Canadian ELD mandate has been pushed back and will not be enforced until January 1, 2023. Originally slated to come into effect this June, the mandate has been pushed back six months due to lack of certified equipment for fleets to purchase.
The Canadian Council of Motor Vehicles has stated that now that certified ELD units are available, thi extension will give carriers time to purchase and install their chosen ELD.
Truck owners will need to choose from a government approved list of 22 certified ELD devices. All devices must be certified by one of three recognized testing bodies.
There are some doubts voiced by the Canadian Trucking Alliance as to whether or not this new deadline will stand. Four provinces, BC, Quebec, Nova Scotia, and Newfoundland, have all yet to introduce any regulations or legislations to require ELDs.
The CTA has voiced its disappointment over the delay, feeling that waiting for a unified response from all jurisdictions is a mistake and that the mandate should go forth and be enforced for greater safety in the industry.
CTA president Stephen Laskowski stated “Without one or both of these commitments, the validity of CCMTA’s January 2023 is in question, It’s time for our industry and those provinces ready to enforce the federal ELD mandate to adjust their sails. The regulation is one of the most important road safety measures in the history of the Canadian trucking industry and, by extension, for the motoring public we share our workplace with.”
Taking the opposite stance is the Private Motor Truck Council of Canada who have released a statement that they are in favour of the delayed deadline. The PMTC feels that the extra time should give all those affected time to implement a unit in their vehicle.
The PMTC also noted that there are still a few details that need ironing out. Such as a need for a PKI vendor and system to be announced by Transport Canada. This is needed to securely transfer ELD data to enforcement. Enforcement personnel will need training for uniform enforcement in all jurisdictions.
But PMTC president Mike Millian noted that he, “… suspect[s] this will be the last delay in full enforcement we can expect to see, and carriers should ensure they are fully prepared to comply by January of 2023.”
